In January 2026 Matthew Berman reviews reporting on documents disclosed in Elon Musk’s lawsuit against Sam Altman and other OpenAI defendants. He discusses early funding and leadership disputes, Microsoft and Nvidia communications, the 2023 board crisis and personal messages between Musk and Altman. The lawsuit’s allegations and each side’s interpretation of the documents are disputed.
- 1A contested lawsuitMusk alleges that OpenAI departed from the nonprofit mission on which he says he funded it. OpenAI disputes his account; court filings are arguments and evidence, not findings of wrongdoing.
- 2Brockman’s notesJournal excerpts describe concerns about Musk’s role and possible funding alternatives. Their meaning and the surrounding negotiations are disputed.
- 3Microsoft preferenceA reported 2016 exchange shows Musk expressing a preference for Microsoft over Amazon. Berman’s conclusion that this was decisive for the later deal goes beyond what the excerpt establishes.

The lawsuit and early leadership tensions
Berman introduces reporting on disclosed documents and Musk’s allegations. He reviews Brockman’s notes and early discussions over funding and control.
Elon Musk’s lawsuit against Sam Altman and other OpenAI defendants has produced many public documents, including emails, messages and notes. I am reviewing a Business Insider article that selects some of them. These materials show what participants said at particular moments, but excerpts and a party’s filing should not be mistaken for a court’s findings.
Musk alleges that he helped fund OpenAI based on a charitable mission and that its later direction departed from that understanding. The defendants dispute his account. The [plaintiffs’ January 2026 filing](https://storage.courtlistener.com/recap/gov.uscourts.cand.433688/gov.uscourts.cand.433688.379.59.pdf) sets out their legal arguments; those claims were contested, and describing a restructuring as illegal is not itself a finding of illegality.

The article describes Greg Brockman’s private notes weighing the consequences of separating from Musk, including a concern that Altman might also leave. Other notes discuss possible sources of funding, including Tesla and Google. These are snapshots of deliberation, not a complete account of a decision; OpenAI disputes the plaintiffs’ interpretation of the broader record.
Nadella, Nvidia and Microsoft
The video discusses Nadella’s deposition, a reported exchange about Nvidia hardware and Musk’s concerns about Google. An early preference for Microsoft is contrasted with the later partnership.
The reporting says Microsoft CEO Satya Nadella testified that his financial adviser invested some of his money in Neuralink. It also recounts his view that Musk has strong opinions but that his way of building companies can be inspiring, and mentions an unpublished book project on AI. These details are presented as deposition and reporting claims.
A reported 2016 email exchange shows Musk asking Nvidia CEO Jensen Huang whether OpenAI could obtain an early system, with Huang saying he would help provide one. Berman connects this to the importance of GPU compute and shows the DGX-1 delivered to OpenAI. That exchange is evidence of an early hardware request, not proof of a single person’s exclusive insight into scaling.
The article quotes a January 2018 email in which Musk warned that OpenAI could fall behind Google and expressed dissatisfaction with its management. He said his involvement might rise if things changed or otherwise fall substantially. The message reveals his view at that time; the reasons for the subsequent separation are broader and disputed.

Another reported exchange from 2016 shows Musk asking about Amazon and expressing a slight preference for Microsoft, while Altman described problems in talks with Amazon. OpenAI and Microsoft announced a partnership in 2019. I find the earlier exchange interesting, but my suggestion that it determined the later partnership goes beyond what the excerpt alone proves.
Messages during the 2023 board crisis
Berman reviews a group conversation about potential ways to return Altman and Brockman. The participants discuss contingencies and the board’s response.
The video next shows messages among Altman, Nadella and Bret Taylor during the November 2023 crisis after the board removed Altman. Altman discusses a possible plan involving interim CEO Mira Murati rehiring him and Brockman while an injunction was considered. The displayed thread also mentions a subsidiary as a fallback; its exact meaning is not established by this excerpt.

Taylor says he personally supports stabilizing the organization, and Nadella discusses calls about the legal situation. Taylor then lists proposed conditions including Altman’s return as CEO and a board seat. Taylor became chair of the new board after the crisis; he was not chair of the board that initially removed Altman.

As the group waits for the board, Altman reports unanswered messages and says others have heard that an alternative CEO might be sought. Later updates describe Murati speaking with board members. The thread is a partial view of a fast-moving negotiation and does not establish who drove the original firing or all of the board’s reasons.
Altman and Musk’s personal exchange
Berman recounts messages about public criticism and Musk’s response. He offers his own interpretation of Musk’s behavior.
Finally, the article recounts a February 2023 exchange in which Altman told Musk that his public criticism of OpenAI hurt him. Musk replied that he did not intend to hurt him, apologized and said he believed civilization’s future was at stake. I interpret his conduct as reflecting strongly held convictions, but his motives and the merits of the dispute remain matters of interpretation.
